A BILL to amend article fourteen, chapter eighteen-b of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
three-a, relating to authorizing southern West Virginia
community and technical college to sell its property in
Madison; and depositing the moneys in its special revenue
account.
Be it enacted by the Legislature of West Virginia:
That article fourteen, chapter eighteen-b of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
three-a, to read as follows:
ARTICLE 14. MISCELLANEOUS.
§18B-14-3a. Southern West Virginia community and technical college; authorization to sell Boone County
property.
(a) Notwithstanding section three of this article, southern
West Virginia community and technical college, with the approval
of the board of directors of the state college system, is
authorized to solicit interest in, enter into a contract for
sale, sell and convey, for good and valuable consideration as
negotiated by the board, the following three parcels of land
bounded and described as follows:
(1) Tract No. One (Boone County campus building and lot) --
That certain lot or parcel of land together with the building
thereon known as the Southern West Virginia Community and
Technical College, situate in Madison, Scott District, Boone
County, and described as: Beginning on a stake in the line of
Main Street at the upper or southern front corner of the lot
conveyed by the deed from Lewis Hubbard Corporation; thence down
the hill with the upper or southern side line of said Lewis
Hubbard Corporation lot to the right-of-way line of the
Chesapeake and Ohio Railway Company; thence in the direction of
down the river with said right-of-way line and a portion of the
rear line of said Lewis Hubbard Corporation lot a distance of
seventy (70) feet to a stake; thence up the hill through said
Lewis Hubbard Corporation lot by a line paralleling the first line above described, and a uniform distance therefrom of seventy
(70) feet to the line of said Main Street; thence with the line
of Main Street a distance of seventy (70) feet to the place of
the beginning.
The said parcel of land with the building thereon (former
Hunter and Hunter Funeral Home), as described above, has a
frontage of seventy (70) feet on said Main Street, with a rear or
railway right-of-way line of the same length, and extends from
the line of Main Street to the said right-of-way line; and is the
upper or southern seventy (70) foot part and portion of the lot.
(2) Tract No. Two (Parking lot toward the city of Madison) --
That certain lot or parcel of land situate in Madison, Scott
District, Boone County, and described as: Beginning on Main
Street on the lower line of a 27 ½ foot lot described in a deed
to W.T. Hunter from M.A. Gore and wife, which deed is dated
September 16, 1924, and is recorded in the office of the Clerk of
the County Commission of Boone County in Deed Book 27, at page
381; thence up and with the line of Main Street a distance of
57 ½ feet, more or less, to the lower line of a lot with a
frontage of 70 feet and described in a deed dated December 27,
1945, and is recorded in said Clerk's office in Deed Book 74, at
page 386; thence leaving Main Street and running with the lower
line of said 70 foot lot described in the deed last above
referred to, to the right-of-way line of the Chesapeake and Ohio Railway Company; thence in the direction of down the river with
said right-of-way line to the lower line of said 27 ½ foot lot
described in the first deed above referred to; thence with the
lower line of said 27 ½ foot lot to the place of the beginning,
making a parcel of land with a frontage of 57 ½ feet, more or
less, and extending from the said Main Street to the said
railroad right-of-way line.
The above described tracts, numbers one and two, were recorded
on December 13, 1983, in Boone County Deed Book 171, at page 564.
(3) Tract No. Three (Other parking lot) -- That certain lot or
parcel of land situate in Madison, Scott District, Boone County,
and described as: Beginning on a corner of the lot owned at the
time of his death by W.P. Croft, just below the old frame store
building in which he formerly conducted a retail mercantile
business; thence running a straight line to a stake on the right-
of-way of the Chesapeake and Ohio Railway Company; said stake
being in the direction of up the river a distance of sixty (60)
feet above the corner of the lot formerly owned by R.G. Hubbard,
later by Lewis Hubbard and Company and later owned by Hunter and
Hunter; thence down and with said railway right-of-way a distance
of sixty (60) feet to the upper corner of the said Hunter and
Hunter lot; thence running parallel with the first line above
described, and a uniform distance of sixty (60) feet therefrom,
to a stake on the line of Main street; thence up and with the line of Main street a distance of sixty feet to the place of
beginning; making the lot hereby conveyed sixty (60) feet wide,
fronting on Main Street, and extending the entire distance from
the said street to the said railway right-of-way line.
The above described tract number three, was conveyed in
undivided interests, which transfers were recorded on December 2,
1988, in Boone County Deed Book 188, at pages 165, 168 and 171.
(b) The proceeds from the sale shall be deposited in a
southern West Virginia community and technical college special
revenue account from which the board of directors of the state
college system is hereby authorized to expend the funds therefrom
for the purchase of or improvement to real property and for
furnishings associated with the purchase of or improvement to
real property at southern West Virginia community and technical
college.
